Terms of Stay

Last updated: October 2026

These terms apply to your stay in our holiday apartments. They add to the statutory rules on tenancy and become part of the contract when you book. If anything is unclear, please give us a call beforehand.

1.Contracting party

Your contracting party is Alfons Kellerer, Meisterhof Ferienwohnungen, Leitzachtalstraße 250, 83730 Fischbachau, Germany, phone +49 8028 2203, e-mail info@meisterhof.com (“we” or “us” below).

These terms apply to the letting of our three holiday apartments for holiday purposes, whether you book online, by e-mail or by phone.

2.How the contract is concluded

Booking online

On the booking page you choose the apartment, your dates and the number of guests and enter your details. Before you send the booking, you see all the details together with the total price and the visitor’s tax and can correct them there.

By clicking “Book now with obligation to pay” you make a binding offer to conclude the contract. We then hold the dates for you for 60 minutes and immediately send you an e-mail stating the apartment, the dates and the total price. This e-mail only confirms that we have received your booking.

With the button “Confirm booking with obligation to pay” in that e-mail you confirm your offer within 60 minutes. We accept it by then sending you the booking confirmation by e-mail, and with it the contract is concluded. The booking confirmation contains all the details of the contract and these terms. If you do not confirm in time, your offer lapses and the dates become available again.

Should the apartment have been taken in the meantime, for example by a simultaneous booking through another portal, we will let you know straight away. In that case no contract is concluded.

We conclude the contract in the language in which you book, German or English. These terms are available in both languages, and both versions are equally valid. We store the text of the contract, and you receive it by e-mail with the booking confirmation.

Booking by phone or e-mail

If you book by phone or e-mail, the contract is concluded when we confirm it in text form, usually by e-mail.

3.Prices and visitor’s tax

The price that applies is the one shown to you before you click “Book now with obligation to pay” and stated in the booking confirmation. It covers the rent and all mandatory costs, final cleaning included. Bed linen and towels are included in the price.

The rent depends on the number of guests and the length of the stay, as shown in the rate list on our Rates and Booking page. Supplements for a dog or an extra bed are only charged if they apply to your booking, and they are then shown in advance as a separate line in the price summary.

On top of this comes the visitor’s tax (Kurbeitrag) of the municipality of Fischbachau. Per night it is €3.00 for guests aged 18 and over and €1.50 for children aged 6 to 17; children under 6 are free. The days of arrival and departure count together as one day. The guest card is included in the visitor’s tax. We collect the tax on behalf of the municipality and show it before you book, both as a separate line and in the total amount. If the municipality changes the rates, the rate at the time of your stay applies.

4.Payment

You pay the total amount, including the visitor’s tax, in cash on arrival, and no deposit is required. Please bring the amount in cash, as we accept cash only.

5.No right of withdrawal

There is no statutory right of withdrawal for booking a holiday apartment for fixed dates (Sec. 312g(2) no. 9 German Civil Code). Your booking is therefore binding. If you cannot come, the rules on cancellation in the next section apply.

6.Cancellation

You may cancel the contract at any time before arrival. Please let us know in text form, that is by e-mail or letter. The day your message reaches us is what counts.

Under German law you remain obliged to pay the agreed price even after cancelling (Sec. 537 German Civil Code). We do, however, take into account what we save through your cancellation and charge the following flat rates:

Cancellation charges
When you cancelCharge
45 days or more before arrivalfree of charge
44 to 30 days before arrival40% of the accommodation price
29 days or less before arrival, and if you do not arrive80% of the accommodation price

The accommodation price is the agreed price without the visitor’s tax. You do not pay the visitor’s tax if you cancel.

You are entitled to prove that we have suffered no loss or a significantly lower loss, in which case you only pay the lower amount.

We make an effort to let the apartment to someone else for the vacated period. If we succeed, we credit the income against the cancellation charge.

We will send you an invoice for the cancellation charge, payable within 14 days.

We recommend taking out travel cancellation insurance. It covers the costs if, for example, you cannot come because of illness.

7.If you do not come or leave early

If you do not arrive and have not told us, this counts as a cancellation on the day of arrival, with the charges from the table above. If you are running late, please let us know. Without word from you we keep the apartment free until 12:00 on the day after the agreed arrival date; after that we may let it to others.

If you leave earlier than booked, the agreed price remains payable. We take into account any expenses saved and any income from re-letting. You only pay the visitor’s tax for the days you actually stayed.

8.Arrival and departure

On the day of arrival the apartment is ready for you from 15:00, and on the day of departure please leave it by 10:00.

Please let us know your approximate arrival time when you book, so that we can welcome you.

The minimum stay is at least 2 nights, or at least 3 nights for arrivals in July, August or September. What counts is the day of arrival, and you can arrive on any day of the week.

You fill in the registration form with us when you arrive. It contains the details the municipality requires from every guest for the visitor’s tax (see our privacy policy).

9.Occupancy

Each apartment sleeps up to 5 people, children and babies included. It is furnished for 4, and anyone beyond that sleeps on an extra bed, which costs €15.00 per night. There is baby equipment in every apartment, so please tell us what you need when you book. More people than booked may only stay overnight in the apartment by arrangement with us.

10.Dogs

Dogs are welcome in the Ground-Floor Apartment and the Balcony Apartment, with no more than one dog per apartment, and the Top-Floor Apartment is dog-free. Please state your dog when you book, online by ticking “We are bringing a dog”. Our booking confirmation, which lists the dog, then makes it agreed. We charge €15.00 per night for the dog, shown in the price summary before you book.

As the owner, you are liable for any damage your dog causes under the statutory rules (Sec. 833 German Civil Code).

11.House rules in brief

  • Please take good care of the apartment and its furnishings. If something breaks or does not work, let us know straight away so that we can fix it quickly.
  • The tiled stove in the top-floor apartment must not be lit.
  • The Meisterhof is a working farm with animals and machinery. Guests please only go into the cowshed together with one of the family, and children also with a parent. Please do not leave children on their own anywhere on the farm either, and follow the family’s instructions and the signs on the farm.

12.Children, the farm and the playground

The duty to supervise children lies with their parents or the adults they are staying with. Your stay on the farm and the use of the playground, the football pitch and the play equipment, such as the trampoline, swing, slide, table tennis table, table football and go-karts, are at your own risk.

This does not affect our liability under the section on “Liability”. In particular, we remain liable without limitation for injury to life, body or health and for damage we cause intentionally or through gross negligence.

13.Cancellation by us

If the apartment becomes uninhabitable for reasons beyond our control, such as fire or storm damage, we will tell you immediately. The contract then ends, and you pay nothing for the days lost.

If a guest seriously breaches these terms despite a warning, we may terminate the contract without notice for good cause (Sec. 543 German Civil Code).

14.Liability

We are liable without limitation for injury to life, body or health and for damage we cause intentionally or through gross negligence. In cases of slight negligence we are only liable if we breach an essential contractual obligation, and then only up to the foreseeable damage typical for this type of contract. Essential obligations are those that make your stay possible in the first place and on which you may rely.

You are liable under the statutory rules for any damage that you, your fellow travellers or your dog cause in the apartment or on the farm. Please report any defects to us immediately so that we can put them right (Sec. 536c German Civil Code).

15.Consumer dispute resolution

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. If you have a question or a complaint, please contact us directly.

16.Final provisions

German law applies. If you are a consumer habitually resident in another country, you keep the protection of the mandatory provisions of the law of that country.

If any of these provisions is invalid, the rest of the contract remains valid, and the statutory rules take the place of the invalid provision.

If you would like to ask anything about these terms before booking, just give us a call.
